Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MakinRatewebsites, web app, and mobile applications (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not an official Navy product
MakinRate is an independent study aid. It is not affiliated with, endorsed by, sponsored by, or an official product of the United States Navy, the Department of Defense, or any other U.S. government entity. Official advancement policy, bibliographies, and exam content are determined solely by the Navy and other competent authorities. Always verify critical information against official sources.
2. Eligibility
You must be able to form a binding contract under applicable law to use the Service. The Service is intended for adults preparing for Navy advancement-related study. You are responsible for ensuring your use complies with applicable laws, regulations, and command policies (including any rules about personal devices, OPSEC, and study materials).
3. Accounts
- You must provide a valid email address and keep account information reasonably accurate.
- You are responsible for activity under your account and for keeping access to your email (and password, if set) secure.
- We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for other users or our infrastructure.
- You may delete your account as described in the Privacy Policy (in-app deletion when available, or by emailing support).
4. The Service (what we provide)
MakinRate provides AI-assisted study tools related to Navy advancement bibliographies and related public study materials, including chat tutoring, progress features, and informational modules. Features may change, expand, or be discontinued as we develop the product.
Access may be free for some or all features. We may introduce paid plans later; we will describe pricing and billing terms before charging you. The Service is currently offered without in-app purchases unless we state otherwise in the store listing or product UI.
5. AI content and no exam guarantees
- Tutor answers are generated with automated systems and may be incomplete, outdated, or wrong even when citations are shown.
- Citations, when present, are aids for study—not a warranty of correctness or of what will appear on any exam.
- We do not guarantee selection, promotion, a particular score, or any career outcome.
- The Service is not a substitute for official instruction, command guidance, or your own verification of source publications.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access other users’ accounts, disrupt the Service, or probe our systems without authorization
- Reverse engineer, scrape at abusive volume, or resell the Service except as allowed by law
- Upload malware or content you do not have rights to use
- Misrepresent MakinRate as an official Navy or DoD product
- Use the Service to generate or disseminate classified, controlled unclassified, or other restricted material in violation of law or regulation
7. Intellectual property
The Service—including software, branding, and original content we create—is owned by us or our licensors. Official Navy publications and other third-party materials remain the property of their respective owners; your use of those materials remains subject to applicable law and source terms. You retain rights to content you submit (such as chat questions), and you grant us a limited license to process that content solely to provide and improve the Service.
8. Third-party services
The Service relies on third-party infrastructure and AI providers (including model and embedding APIs). Those services have their own terms and privacy policies. We are not responsible for third-party outages or changes outside our reasonable control.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKINRATE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CAREER OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
11. Indemnity
You will defend and indemnify MakinRate and its operators against claims arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law, to the extent permitted by law.
12. Termination
You may stop using the Service at any time and may request account deletion. We may suspend or stop providing the Service (in whole or in part) with or without notice, including for maintenance, abuse, legal risk, or discontinuation of the product.
13. Changes
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Material changes may also be communicated by email or in-app notice when practical. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where prohibited by applicable law. You agree that courts in the United States will have jurisdiction over disputes arising out of these Terms, except where applicable law requires otherwise. If you later operate the Service through a registered business entity, we may update this section to name a specific state venue.
